Hi so I'm a landlord in Wales and I'm wondering how long it takes to take my tenenants to court? They are ment to be moving out next month but I am suspicious they won't leave and I know I have two months to apply to the courts and try to get them removed that way. Reason for my suspicion: I've been communicating with them these last 6 months they've had to try to find a place and each time I've found a place within their budget, they have turned it down. They always find a reason as to why a place either I have found or they have found is wrong so I'm wondering how long it takes to apply to the courts. If they still don't leave after taking them to court what happens next? Thanks 👍
If you serve a section 21 notice they have 2 months to vacate or 6 months if it’s a 12 month contract, if they don’t leave then you have to apply to the courts within 6 months of the section 21 notice expiry. Getting a court possession orders takes an average of 6 weeks and then another 4-10 weeks if bailiff eviction is needed - all assuming there are no court delays.
They've lived in my house for quite some time now and they've had their 6 months and I know I have 2 months when their 6 months is up to apply to the courts if they are not gone. So are you saying it takes roughly 6 weeks for go and apply to the courts?
You can apply in the 6 months after the notice expiry date, when you apply it takes 4-10 weeks (again could be months if there’s delays) to be granted the CPO, if they still haven’t left after that you have to get a warrant for possession or high court enforcement which can take another 4-10 weeks before the bailiffs can evict
