8k to recover - next steps?

I sued my tenant for posessrion on unpaid rent grounds and got 8k from court. I think it’s CCJ? Tenant is apologetic but not paying. What should be my next step - apply for high court directly or employ some company straight away? Note I might need tracking service for second tenant

I would have said apply to the court straight away, but if it’s more complicated, like having to use a tracing service, then I personally would be inclined to use a professional for the whole service.

any idea how much will that recovery cost ? Or it should be no win no fee and recovered from tenant ? Any recommendation on firms ?

I would use a fee based service that charges a percentage, they seemed better in my opinion, but it was a long time ago so things may have changed, for that reason, I don’t want to recommend anyone and cause you problems. But good luck, 8k is a lot of money, don’t give up.

Are you sure the tenant has the money? Defaulting tenants rarely have any cash, that is why they default. Unless you know they have assets that are easily available it’s likely that throwing more money at legal action will just add to your losses.

For the small additional cost all Landlords should go for a CCJ. In the future their financial position may change. You can then go for attachment of earnings. Even if it takes years you have a chance at getting the money back. The CCJ will haunt them every time they try to rent or get credit for anything.

If every landlord did this we would have a lot less problems with unpaid rent. The CCJ would show up in our checks and we wouldn’t accept them.

Totally agree and as a LL I feel that responsibility to gain a ccj for both myself and for others so that other future people don't get ripped off.

I think now that section 21 is being abolished the rise of attached CCJs for non payment of rent will also rise and maybe in the end be a good thing as long as LL do their due diligence at the selection stage.

I see your point re the CCJ but I don’t think it practical to try and keeps tabs on a disappearing tenant to see if their financial position improved in future.

Chase them until they pay however long it takes, they need to know they can’t go through life shafting people and that there are future repercussions. Oh and prepare for the mental health ticket from them🥱

Does the tenant have a job? If yes apply for deductions by salary or you can choose to apply to freeze his bank accounts. These options you need to apply through court and they will assess if he has money in savings or how much money he has left after living expenses. If he has no job then its just harder to get your money back. Both scenarios apply for CCJ regardless.

did you see evidence of Work and income when you onboarded tenant. If you had an agent source it i always ask for proof. i think someone mentioned it on this post its called Attachment of earnings for deductions on income.

I got a CCJ for unpaid rent. 2 years on the court finally gave the attachment of earnings order and the debt is being repaid on a monthly basis directly from their salary. Definitely worth pursuing. Got debt collectors too but that was pointless and not worth the hassle.

You’ve got a £8k CCJ. If you know where they are, use Form N293A to transfer it to the High Court for a £71 fee, then instruct a High Court Enforcement Officer to collect. If you don’t know, pay for a proper debtor trace first, then instruct HCEOs. HCEOs act fast and have more powers than County Court bailiffs.

I wouldn't assume it is a ccj, I was awarded at court money section 8 possession rent arrears. I paid for a trace and turns out they didn't have a ccj. Getting it to a ccj I think is another form can anyone fill in the gaps as I would like to know what steps I missed and it may help op out too.

I’m f your not sure they have money , then ask court for a verbal instruction where they have to attend court and you can ask under oath what income and possessions they have etc ,,, I always go for ata hammy of earning myself so it gets deducted at source from their employer
