Section 8 eviction. No Eicr given

Hi. A friend of mine has a tenant whom is in 6 months of rental arrears. She has appointed a solicitor to represent her as she’s too nervous to stand in front of a judge.

She was basically scammed regards her EICR so doesn’t hold a valid one for the property. Will this invalidate the section 8? To my understanding it will strike a S21 but not S8.

She told me the second the tenants are out she has an electrician that’s ready to do the required tests etc.

Tenants have also blocked her and not responding to any form of communication. The vast amount of the arrears were accumulated when UC were paying tenants for their rent but they were keeping for themselves…..now the payments are being paid directly to her.

CN the tenants claim disrepair? Even if they have not notified her as the landlord of anything ? The 2 issues that were risen, were dealt with with the space of a week

Appreciate your help on this, I’ve been trying to put her at ease. She’s veeeeery stressed about it all

Not relevant to Sect 8 possession. If arrears are over £5K or more than 6 months get solicitor to apply for permission to transfer the order when given to the High Court for enforcement. If the claimant doesn’t they will be waiting months on end for bailiff appointment.

if tenant doesn't notify landlord about issues, obviously the landlord doesn't know about it and therefore can't act. So no, they can't claim disrepair.

Not having an EICR is frowned upon. Not entirely sure how EICR can be scammed or invalid .... you need to elaborate more on that.

EICR is basically a report, so either you have a report or you don't.

Next is what is within the report, if there are urgent issues mentioned within that require urgent attention and remediation, the landlord should get the work done.

I think it was a cowboy electrician who isn’t qualified to give an EICR. She said he was over for 2 minutes and didn’t have any machines for testing…

Huh ? For real, 2 mins ? So your Landlord friend hired a cowboy to do the job ?

She clearly knew it wasn't done but didn't do anything to get an actual electrician to conduct the EICR ?

Yeah, I mean I had a guy take 2 hours for my 3 bed. So yeah. Assuming that she knew it wasn’t done is a little mean. But yes. We live and learn I guess

EICR wouldn’t affect section 8.

Keep all repairs information In email and not on phone, so this is evidence. Make sure they chase all repairs. Even if they don’t reply, doesn’t matter,

Also make sure you get a CCJ on this person for their credit file, so it’s hard for them to rent again, when they get away with this, is when they just do it again.
