Now I have recieved the below email from a housing options advisor from the council asking whether I would be willing to let the tenant stay in the property and to say they are able to pay the rent on his behalf. The email is incorrect in that the property is actually 3 bedroom. My preference is that the tenant leaves as soon as possible because I need to move into the property. But is it possible to leverage the council in any way? For example if I negotiate with them a much higher rent eg. £2,400 per month with a direct payment to me from the council? This would allow me to rent alternative accomodation. I haven't replied to the email yet. I've actually sent back the slip on the previous letter with the request for possession order and costs as I did not recieved any appeal in the post after 14 days. My assumption is that the council has also helped the tenant appeal against the eviction notice but perhaps its still on its way to me in the post. Any idea on how to proceed with this, anyone dealt with this scenario?
No. They are offering you an incentive to Renew for one year with rent capped at LHA rates. You could potentially negotiate the incentive but there won’t be any room for negotiation on the rent cap.
If you need the house back to live in, just tell the housing officer that. They will advise the tenant to stay put until you have a possession order, but they will then help your tenants find accommodation once you do have possession granted.
Or they might advise the tenants to wait until the bailiffs arrive. That’s what they’re saying around here.
