Yearly Tenancy about to end and tenants have informed us they are looking to move to a larger property, what do I do with the agreement?

Bit more context, my tenants have advised me they are trying to find a larger property to move to their current tenancy ends at the end of January and we informed them we were about to increase the rent by £95 per month.

As they haven’t found anywhere yet I assume between us we can just agree to a rolling tennancy till they move out but I’m not overly sure how I go about this as a short term thing

Any pointers

Planning on contacting the NLA tomorrow for advice

Do nothing. Wait until they hand in one month notice informing you they intend to vacate.

The tenancy automatically becomes a rolling / periodic tenancy on the same terms as it was before. You don't need to do anything. 

You can use a section 13 to increase the rent, but it may not be worth the faff if they're leaving anyway.

You don’t need to use a section 13… if you have an amicable relationship with them it’s perfectly normal just to email them and give them a months notices that the rent will be increasing (I normally point out that it’s still a good rate compared with other comparable properties on Rightmove) and ask for their agreement. Unless they disagree there’s no need for the faff of a section 13 notice.

Yeah you’re better off having them on a rolling contract for a couple of months at the current rent until they find a new place.

Way better/easier to find tenants from March/April onwards than January

Send the rent increase notice. Make sure its sent with the required notice period (2 months i think) , £95 seems like a lot though. Then just continue on a rolling tenancy

If the fixed term is at the end of January, they’ve probably already missed the review date.

You just do nothing and wait for them to hand to in their one month’s notice. Rent stays the same.

Just as an updated, the tenants turned round and said they were going to stay as long as they could and didn’t want to pay more rent, so they have now been served a s21, sucks but they said they just want a council house and to stop privately renting

Just get agreement of rolling tenancy and rent increase. Check if you need to redo deposit protection and provide prescribed information. Do ensure the new rent is towards market levels for periodic.
