Updating post from Reddit.
I offered some years ago to manage everything on behalf of my aging parents as previous tenants has wrecked the house, not paid rent etc, and caused them immense stress. It's been an informal arrangement with nothing in writing, so to speak.
Specifically (and unexpectedly) it looks as though a Section 8 is needed and I wonder if this is issued by me in MY name, or with THEIR details as the owners & who the rent is paid directly to. The tenancy agreements have been issued with me as the landlord, if that has any bearing.
Lastly, I gather that the process is or could be messy. Would it be advisable to pass it to a solicitor or is it something that's manageable?
Thank you.
I'd suggest your parents maybe look into get an agent who has done this before.
You seem out of your depth and that could lead to messy situations which you wouldn't be able to get them out of.
You are not the Landlord. The tenancy agreement is therefore incorrect, probably best take legal advice if you’re thinking of Section 8.
Not legal advice but would assume you need to put your parents’ names as the legal owners of the property.
Perhaps join NRLA as they have a helpline you can call
You can sign it as you're acting as an agent of the landlord, this needs to be stated on the notice. I agree about joining the NRLA or getting legal advice - avoid eviction services from online searches, most of them use paralegals only and charge ridiculous amounts added on due to their own mistakes.
>Who needs to sign the notice
>A valid notice must be signed by the landlord or the landlord's agent.
>The Court of Appeal held that a valid section 8 notice can contain the name and address of the landlord's agent instead of the landlord's details.
>A section 8 notice can be signed by an employee of the landlord if the landlord is a company. It does not have to be signed by a director of the company.
Thank you so much!
